Introduction

This Insurance Policy ("Policy") outlines the terms and conditions under which AV Shack ("we," "us," or "our"), a subsidiary of AV Zone, provides insurance coverage for purchases made through our website, www.avshack.in. By opting for insurance coverage, you ("Customer") agree to the terms of this Policy.

Coverage Details

  • Insurance Rate: The insurance coverage is provided at a rate of 2.5% of the total cart value.
  • Minimum Charge: A minimum charge of ₹250 applies to all insurance coverage.
  • Maximum Cart Value: Insurance is available for cart values up to ₹4,10,000.
  • Increment Value: Insurance charges are calculated and rounded to the nearest ₹100 increment.

Scope of Coverage

  • Damage: Refers to physical harm that impairs the value, usefulness, or normal function of the insured product. This does not include minor scratches, dents, or cosmetic wear and tear that do not affect the performance of the product.
  • Theft: Refers to the unlawful taking of the insured product during transit, up until the point of delivery by our courier partner. Once the product has been handed over to the customer, theft coverage no longer applies.
  • Loss: Refers to the misplacement or disappearance of the insured product during transit, where the location is unknown and recovery is not possible.

Exclusions

  • Minor scratches, dents, and cosmetic wear and tear that do not affect the performance of the product.
  • Damage resulting from improper handling by the customer after delivery.
  • Products modified or repaired by the customer without prior authorization.
  • Any indirect, incidental, or consequential damages.

Claims Process

  1. Notification: The customer must notify us of any damage, theft, or loss within 48 hours of delivery by contacting our customer service at support@avshack.in.
  2. Documentation: Customers must provide the following documentation:
    • Proof of purchase.
    • Photos and/or videos of the damaged product or proof of loss/theft.
    • Any additional information requested by our claims department.
  3. Inspection Period: Upon receipt of the claim and required documentation, we will inspect and verify the claim within 3-4 business days.
  4. Approval and Store Credit: Once the claim is approved, the customer will be issued store credit equivalent to the value of the insured item(s).
  5. Repair and Return: If we determine that the damage is covered under this Policy, we may request the customer to return the damaged product to us for repair. Upon repair, the product will be returned to the customer at no additional cost.

Limitation of Liability

AV Shack, its parent company AV Zone, and its affiliates will not be liable for any indirect, incidental, or consequential damages arising from the use of this insurance policy. In no event shall AV Shack’s total liability exceed the total value of the insured item(s).

In the event that a customer fraudulently or inadvertently obtains insurance coverage for a cart value exceeding ₹4,10,000 due to a system glitch or technical error, AV Shack shall not be liable to cover any damage, theft, or loss of the product(s). Furthermore, we reserve the right to seek indemnification from the customer for any fraudulent claims or misrepresentations.

If it is determined that the insurance value charged was incorrect due to a systematic glitch from the final user's end, AV Shack will not be liable for any miscalculated coverage, and the customer agrees to indemnify and hold harmless AV Shack, AV Zone, and its affiliates from any claims, losses, damages, liabilities, including legal fees, arising out of such incidents.

Indemnification

The customer agrees to indemnify and hold harmless AV Shack, AV Zone, and its affiliates from any claims, losses, damages, liabilities, including legal fees, arising out of the customer's violation of any terms of this Policy.

Governing Law

This Policy shall be governed by and construed in accordance with the laws of the Republic of India. Any disputes arising out of or in connection with this Policy shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.

Amendments

AV Shack reserves the right to amend this Policy at any time without prior notice. The latest version of the Policy will be available on our website.

By opting for insurance coverage, the customer acknowledges that they have read, understood, and agreed to the terms and conditions of this Policy.
